음악저작권법 시행에 관한 문화관광부 공지 지난 2005년 1월 16일 부터 문화관광부에서 개정한 음악저작권법이 시행되었습니다.

1월 17일자로 발효되는 새 저작권법에 대해 오해와 혼란이 있어 이를 바로 알리고자 합니다. 새 저작권법은 실연자(가수, 연주자)와 음반제작자에게 그의 실연 및 음반에 대한 전송권을 새로이 부여하였습니다. 이전에는 작곡, 작사가 등 저작권자만이 전송권을 가지고 있었기 때문에 온라인상의 전송행위 등에 대해 그 권리를 주장할 수 있고, 실연자와 음반제작자 등은 그 권리를 주장할 수 없다고 하는 주장이 있을 수 있어 혼란이 있었으나 이번 법 발효에 따라 그러한 논란은 더 이상 필요없게 되었습니다.
이번 법개정 이유는 인터넷 등 통신망을 이용한 음악저작물의 전송이 빠른 속도로 확산됨에 따라 음반의 유통구조가 온라인으로 급속히 전환되는 추세를 감안하여 저작인접권자(실연자, 음반제작자)의 경제적 권리를 보호하고 실연자와 음반제작자에게 전송권을 부여하는 전세계적인 추세를 감안하는 동시에 우리나라가 조만간 가입예정인 세계실연음반조약(현재 48개국 가입)상의 의무조항이기 때문입니다.
많은 분들이 오해를 하는 것은 이전에는 블로그나 카페에 음악파일을 올려놓는 행위 등이 합법적이었으나 이번 법 발효에 따라 불법화되었다는 내용입니다. 이는 저작권법을 잘못 이해한데서 오는 오해라고 할 수 있습니다. 동법 발효와 관계없이 이전에도 상기행위는 저작권자의 경우 전송권과 복제권을 침해한 행위로 불법이었고, 실연자와 음반제작자에게는 복제권 침해행위로 불법행위였습니다. 다만 이번에 실연자와 음반제작자에게 저작권자와 마찬가지로 전송권을 부여하여 이를 더 확실히 한 것 뿐입니다.
많은 분들이 개인 블로그까지 단속의 대상이 되느냐 하는 우려를 하고 있습니다. 저작권 침해행위로 처벌하기 위해서는 권리자의 고소가 있어야 합니다.(친고죄 조항). 따라서 개인 블로그 글에 대한 침해여부 판단과 고소여부는 전적으로 권리자의 자유의사에 달려 있다고 할수 있습니다. 특정 블로그(A)의 글을 누군가 임의로 허락없이 퍼가서 자신의 블로그(B)에 올리거나 전송했을 경우 그 특정 블로그(A)의 저작권자만이 퍼간 네티즌에게 책임을 물을 수 있으며 고소여부 등은 그의 자유의지에 달려 있다고 할 수 있습니다. 이것이 인터넷의 자유로운 유통을 막는다는 얘기가 있지만 법적으로 A에게 는 자신의 글이 타인에 의해 복제되는 것을 막을 권리가 있기 때문에 이를 박탈하는 것은 어느 법제를 보더라도 불가능한 일입니다. 지금까지 이런 펌행위가 문제시 되지 않은 것은 저작자가 자신의 블로그에 쓴 글을 누가 퍼가도 아무런 제재를 하지 않은 때문입니다만 앞으로 저작권 인식이 높아지면 자신의 블로그 글을 장래 출판목적으로 꾸준히 게시하는 경우 등에는 펌행위를 고소하는 사례도 발생할 수 있을 것으로 보입니다. 음악파일의 경우에는 실제 이를 통해 이익을 창출하는 저작권자등이 존재하기 때문에 권리보호가 더 확실하다고 할 수 있습니다.
많은 분들이 단속에 대해 우려를 표하고 있습니다. 조만간 권리자단체가 연합하여 저작권 침해행위 방지를 위하여 행동을 취할 것으로 보입니다만 우선 주 타켓은 영리를 목적으로 하는 저작권 침해행위나 대규모로 저작권을 침해하는 사이트가 대상이 될 것으로 보입니다. 현재 수만~수십만명의 회원으로 구성된 일부 음악영상 카페 등은 수많은 음악 또는 영상파일을 업로드해놓거나 음악메일을 매일아침 발송하는 등 권리자의 영업이익을 간접적으로 해치고 있는데 이런 경우가 우선 대상이 될 것입니다. 동 단체들은 이런 경우에도 일정기간 계도기간을 거칠 것으로 알고 있습니다.
최근 인터넷에 돌고 있는 내용중 길거리에서 노래를 부르거나 학교조회에서 애국가를 부르는 것이 불법이라는 등의 내용은 모두허위임을 알려드리니 착오 없으시기 바랍니다. 우리 저작권법은 저작권자의 권리뿐만 아니라 문화발전을 위해 일반 사용자들의 저작물 이용권도 같이 보호하고 있습니다. 예를 들어 정당하게 구입한 CD로부터 mp3 파일을 추출하여 온라인 공유없이 가족들이 같이 듣는 것 등은 얼마든지 가능한 일입니다. 다만 소리바다와 같은 공유 사이트에서 불법복제된 음악파일을 다운받아 이를 전파하는 행위는 남의 것을 무단으로 사용하는 저작권침해행위임을 바로 인식해 주시기 바랍니다.
